Terms of Service

1. Acceptance of Terms

By accessing or using LaunchKit ("Service"), operated by Labs365 ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

LaunchKit is an AI-powered platform that generates marketing assets - including landing page copy, social media content, and pitch materials - for software products and applications. The Service operates on a freemium model with free and paid subscription tiers.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You may not share your account with others or create accounts on behalf of third parties.
• You must be at least 13 years of age to use the Service.

4. Subscription Plans and Billing

LaunchKit offers the following plans:

• Free - limited kit generations using our standard AI model.
• Builder - a one-time purchase granting 5 lifetime kits and expanded features.
• Pro - monthly subscription with 20 kits per month and premium features.

All payments are processed by Paddle, which acts as the Merchant of Record and handles applicable sales tax and VAT on our behalf. By completing a purchase you agree to Paddle's terms of service in addition to these Terms.

Subscription fees are billed in advance. If you are not satisfied, you may request a full refund within 14 days of your purchase by contacting us at support@getlaunchkit.dev. Refund requests made after 14 days will not be accepted. We reserve the right to modify pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, defamatory, or infringes third-party rights
• Attempt to reverse-engineer, scrape, or otherwise extract data from the platform
• Circumvent usage limits, rate limits, or access controls
• Use the Service for spam, phishing, or deceptive marketing
• Transmit malware or attempt to disrupt the Service
• Impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

Your content: You retain ownership of all input data you provide to the Service (app descriptions, URLs, etc.). You grant us a limited, non-exclusive license to process that content solely to deliver the Service.

Generated content: Marketing kit output generated for you is yours to use commercially without restriction, provided it does not infringe third-party rights. We do not claim ownership of generated output.

Our platform: The LaunchKit platform, brand, codebase, and underlying technology remain our exclusive property. Nothing in these Terms transfers any platform IP to you.

7. AI-Generated Content Disclaimer

LaunchKit uses large language models to generate marketing content. Generated output is provided "as is" and may contain inaccuracies, errors, or content that requires human review before use. You are solely responsible for reviewing, editing, and ensuring the accuracy of any content you publish or distribute. We do not guarantee that AI-generated content is factually correct, legally compliant, or fit for any particular purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Labs365 shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including loss of profits, data, or goodwill - arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Labs365 and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

Either party may terminate the relationship at any time. You may cancel your account through account settings. We may suspend or terminate your access for violation of these Terms, non-payment, or any reason at our discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (IP, limitation of liability, indemnification) will survive.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction, as mutually agreed. You waive any right to a jury trial or class action proceedings to the extent permitted by law.

13. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date and notify you via email or in-app notice for material changes. Continued use of the Service after updated Terms take effect constitutes your acceptance of the new Terms.
